Humanitarian Status in Georgia
1. A person is granted humanitarian status if they are not a citizen of Georgia or a stateless person permanently residing in Georgia, do not meet the criteria established by Article 2 of this law, and:
a) Have been forced to leave their country of origin due to violence, external aggression, occupation, internal conflicts, mass violations of human rights, or significant disturbances of public order;
b) Cannot be forcibly returned to their country of origin due to legal grounds, specifically, Georgia’s international obligations (such as Article 3 of the European Convention on Human Rights, which prohibits torture, inhuman or degrading treatment or punishment) or other international human rights protection acts that impose non-refoulement obligations, and are unable to travel to another country;
c) Would face a serious threat to their life or violations of their rights if they were to return to their country of origin.
2. Humanitarian status may also be granted to a person who is not a citizen of Georgia or a stateless person permanently residing in Georgia and:
a) Was forced to move within Georgia but does not qualify for refugee status under the Georgian Law on “Internally Displaced Persons – Refugees”;
b) Entered Georgia from a neighboring country due to a natural disaster occurring there;
c) Requires other credible humanitarian assistance.
3. A person will not be granted humanitarian status if they meet the criteria established in Article 3, Paragraph 1 of this law, or if their presence in Georgia contradicts the national interests due to other significant circumstances.
4. Humanitarian status is granted for a period of one year and may be extended if the circumstances that led to the granting of this status persist.
A person with humanitarian status may be granted the right to family reunification. This right must be exercised if family reunification has not been possible within one year of obtaining humanitarian status and if it is also impossible in another country.
